AGREEMENT TO TERMS
These Terms and Conditions govern your access to and use of the Public Wills website, platform, software, services, and related materials (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
ADDITIONAL SERVICE TERMS
Certain Services may be subject to separate agreements, subscription plans, product terms, service orders, or other supplemental terms. In the event of any conflict, the applicable supplemental terms shall prevail in relation to the relevant Service.
INTELLECTUAL PROPERTY
All software, content, templates, drafting logic, workflows, trademarks, branding, and proprietary materials made available through the Services are owned by or licensed to Public Wills.
You may not copy, reproduce, distribute, sell, sublicense, adapt, reverse engineer, or create derivative works based on any will templates, precedents, drafting logic, or proprietary content made available through the Services.
USER ACCOUNTS
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
You must provide accurate and complete information and keep such information updated.
FEES AND PAYMENT
Fees for paid Services are payable in Singapore Dollars unless otherwise stated.
All fees are non-refundable unless otherwise required by law or expressly stated by us.
We reserve the right to modify pricing, subscription plans, and service offerings at any time.
ACCEPTABLE USE
You agree not to:
- use the Services for unlawful purposes;
- interfere with the operation or security of the Services;
- attempt to gain unauthorized access to any systems or accounts;
- allow unauthorized third parties to access your account;
- use the Services to compete with Public Wills;
- copy or redistribute proprietary templates, precedents, drafting logic, or content.
TECHNOLOGY PLATFORM
Public Wills is a technology platform that provides tools and workflows to assist users in preparing estate planning documents.
Public Wills does not act as a law firm, solicitor, legal practitioner, executor, trustee, fiduciary, estate administrator, financial adviser, or tax adviser.
Users remain solely responsible for all instructions, decisions, advice, recommendations, and services provided to their clients or third parties.
NO LEGAL ADVICE
The Services are provided as technology-enabled tools for will-writing and estate planning administration.
Nothing on the Site constitutes legal advice, legal representation, financial advice, tax advice, or professional advice.
You are responsible for obtaining independent professional advice where appropriate.
USER RESPONSIBILITY
You are solely responsible for:
- ensuring the accuracy and completeness of information entered into the Services;
- reviewing all documents generated through the Services before use;
- ensuring compliance with applicable laws and legal formalities;
- obtaining all necessary instructions, consents, and authorisations from clients or third parties;
- verifying the identity of clients where applicable.
Public Wills does not verify the accuracy of information provided through the Services.
WILL VALIDITY AND EXECUTION
The validity of any will or estate planning document depends on compliance with applicable laws and execution requirements.
Public Wills does not supervise execution, provide legal advice, assess testamentary capacity, verify witnessing requirements, or guarantee that any document generated through the Services will be legally valid or enforceable.
COMPLEX OR CROSS-BORDER MATTERS
The Services may not be suitable for estates involving foreign assets, multiple jurisdictions, trusts, corporate structures, tax planning, or other complex matters.
Users should seek independent professional advice where appropriate.
CLIENT DATA AND PERSONAL DATA
If you provide personal data relating to any third party, you represent and warrant that you have obtained all necessary consents and permissions required under applicable laws, including the Personal Data Protection Act 2012 of Singapore.
Our collection and use of personal data is governed by our Privacy Policy.
UPLOADED DOCUMENTS
You are solely responsible for the content, legality, accuracy, and completeness of any documents uploaded to the Services.
While we implement reasonable technical safeguards, no electronic system can be guaranteed to be completely secure.
DISCLAIMERS
The Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Public Wills disclaims all express, implied, statutory, and other warranties, representations, and conditions relating to the Services, including any warranties of fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, or suitability for any specific use.
Public Wills does not warrant, represent, or guarantee that:
- (a) the Services will be uninterrupted, error-free, secure, or free from defects;
- (b) any document generated through the Services will be legally valid, enforceable, suitable for any particular circumstance, or accepted by any court, authority, institution, or third party;
- (c) the Services will meet any user's requirements, expectations, or intended outcomes; or
- (d) any information, content, templates, workflows, or materials made available through the Services are complete, accurate, or current.
Users access and use the Services entirely at their own risk.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Public Wills shall not be liable for:
- invalid or unenforceable wills;
- estate disputes;
- probate delays;
- loss of profits;
- loss of revenue;
- loss of data;
- indirect, incidental, special, or consequential damages.
To the fullest extent permitted by law, Public Wills shall not be liable for any indirect, consequential, incidental, special, exemplary, punitive, or third-party damages, including any claims relating to estate disputes, probate proceedings, beneficiary claims, loss of profits, loss of business, loss of goodwill, loss of data, or legal costs.
Without limiting the foregoing, Public Wills' total aggregate liability arising out of or relating to the Services shall not exceed the lesser of:
- (a) the total fees paid by the user to Public Wills during the twelve (12) months immediately preceding the claim; or
- (b) SGD $500.
INDEMNITY
You agree to defend, indemnify, and hold harmless Public Wills, its directors, officers, employees, affiliates, contractors, and representatives from and against any and all claims, actions, liabilities, losses, damages, costs, expenses, penalties, fines, and legal fees arising out of or relating to:
- (a) your use of the Services;
- (b) any information, instructions, or documents submitted by you;
- (c) any services, advice, recommendations, or representations provided by you to any client or third party;
- (d) any dispute involving a client, beneficiary, executor, family member, trustee, or other third party;
- (e) your breach of these Terms; or
- (f) your violation of any applicable law, regulation, or professional obligation.
TERMINATION
We may suspend or terminate access to the Services at any time where we reasonably believe that you have breached these Terms or applicable laws.
PRIVACY
Your use of the Services is subject to our Privacy Policy.
GOVERNING LAW AND DISPUTES
These Terms shall be governed by the laws of Singapore.
The parties shall first attempt to resolve any dispute through good-faith negotiations for a period of thirty (30) days.
If the dispute cannot be resolved, the courts of Singapore shall have exclusive jurisdiction.
FORCE MAJEURE
We shall not be liable for delays or failures caused by events beyond our reasonable control, including system failures, cyberattacks, internet outages, governmental actions, natural disasters, or other force majeure events.
GENERAL
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and Public Wills regarding the Services.
The provisions relating to Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, Governing Law and Dispute Resolution shall survive termination of these Terms.
Where a user has entered into a separate Master Services Agreement, Product Terms, Service Order, or other written agreement with Public Wills, such agreement shall prevail to the extent of any inconsistency with these Terms.

By accessing or using our Services, you acknowledge that you have read and understood this Privacy Policy.

Client Data Submitted Through the Platform

BUSINESS CLIENT DATA
Where a subscribing business client uploads or processes personal data relating to its own clients through the Services, Public Wills generally processes such data on behalf of the subscribing business client.
The subscribing business client remains responsible for:
- Obtaining all necessary consents
- Providing required privacy notices
- Ensuring the legality of data collection and disclosure
- Complying with applicable data protection laws
Public Wills does not independently verify whether the subscribing business client has obtained the necessary permissions to process such personal data.
DISCLOSURE OF PERSONAL DATA
We do not sell personal data to third parties for their own marketing purposes.
We may disclose personal data to:
Service Providers
Third-party providers who assist us in delivering the Services, including:
- Cloud hosting providers
- Payment processors
- Email delivery providers
- Customer support providers
- Analytics providers
- Certification administration providers
Your Organisation
Where you use the Services through a business account, we may disclose information to authorised administrators and personnel within your organisation.
Professional Advisers
Lawyers, auditors, accountants, insurers, and other professional advisers under obligations of confidentiality.
Legal and Regulatory Authorities
Government agencies, regulators, courts, law enforcement agencies, and other authorities where required by law.
Business Transfers

INTERNATIONAL TRANSFERS

Where personal data is transferred outside Singapore, we take reasonable steps to ensure that the transferred data receives a standard of protection comparable to that required under the PDPA.
RETENTION OF PERSONAL DATA
We retain personal data only for as long as necessary to fulfil the purposes for which it was collected or as required by applicable laws.
Generally:
- Account information may be retained during the subscription period and for up to seven (7) years thereafter where required for legal, operational, or compliance purposes
- Client data is retained in accordance with instructions from the subscribing business client and applicable legal obligations
- Uploaded financial documents may be retained only for as long as necessary to provide the requested Services unless otherwise retained by the user
- Certification records relating to the Public Estate Planner™ (PEP) programme may be retained for as long as reasonably necessary to verify certification status, maintain historical certification records, comply with legal obligations, or resolve disputes
Where personal data is no longer required, we may securely delete, anonymise, or destroy it.
SECURITY
We implement reasonable technical and organisational safeguards designed to protect personal data against unauthorised access, disclosure, alteration, loss, misuse, or destruction.
These measures may include:
- Encryption of data in transit and at rest
- Access controls
- Authentication mechanisms

Where you enrol in the Public Estate Planner™ (PEP) programme and provide consent, we may publish information such as:

- Certification status
- Professional profile
- Organisation name
- Qualifications
- Related professional information
for the purposes of certification verification, partner directories, professional listings, and related promotional activities.
You may withdraw such consent by contacting us.
THIRD-PARTY WEBSITES
Our Services may contain links to third-party websites and services.
We are not responsible for the privacy practices or content of such third parties and encourage users to review their privacy policies independently.
CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time.
Where material changes are made, we may notify users through the Services, by email, or by other appropriate means.
Continued use of the Services following any updates constitutes acceptance of the revised Privacy Policy.
GOVERNING LAW
This Privacy Policy shall be governed by and construed in accordance with the laws of Singapore.
Any dispute arising out of or relating to this Privacy Policy shall be subject to the exclusive jurisdiction of the courts of Singapore.

Public Estate Planners™ are independent professionals and are not employees, agents, representatives, partners, or legal practitioners of Public Wills Pte. Ltd.
Public Estate Planners™ must not imply, state, or otherwise represent that they are acting on behalf of Public Wills or have authority to bind Public Wills in any manner unless expressly authorised in writing.
PROFESSIONAL STANDARDS
Public Estate Planners™ shall act professionally, ethically, and in the best interests of their clients at all times.
Public Estate Planners™ are expected to conduct themselves in a manner that upholds the integrity, reputation, and standards of the Public Estate Planner™ certification and the Public Wills platform.
NO LEGAL ADVICE
Public Estate Planners™ are not lawyers and must not represent themselves as lawyers, legal advisers, or providers of legal services.
The Public Estate Planner™ certification does not constitute a legal qualification, practising certificate, or licence to practise law.
Public Estate Planners™ must not provide legal advice and should clearly communicate the scope and limitations of their role to clients.
CLIENT COMMUNICATIONS
Public Estate Planners™ must provide accurate, honest, and professional information regarding their qualifications, services, fees, and experience.
Misleading, deceptive, false, or exaggerated claims are strictly prohibited.
Clients should be provided with sufficient information to make informed decisions regarding will-writing and estate planning services.
ADVERTISING AND REPRESENTATION
Public Estate Planners™ must ensure that all marketing materials, websites, social media content, advertisements, and client communications are accurate and not misleading.
Public Estate Planners™ must not:
- Claim to be lawyers or legal professionals unless appropriately qualified;
- Misrepresent their certification status;
- Make guarantees regarding legal, probate, or estate planning outcomes;
- Use the Public Wills or Public Estate Planner™ brand in a misleading manner.
FEES AND DISCLOSURE
Public Estate Planners™ must clearly communicate all fees and charges before commencing any engagement.
Where applicable, clients should be informed of any fees relating to will updates, witnessing services, consultations, or other ancillary services.
Fee arrangements should be fair, transparent, and communicated in a timely manner.
REFERRAL OF COMPLEX MATTERS
Where a client's circumstances involve complex legal, tax, business succession, cross-border, trust, or estate planning issues, the Public Estate Planner™ should recommend that the client seek advice from a qualified legal professional or other appropriate specialist.
The interests of the client should take priority over any referral, commission, or commercial arrangement.
CONFIDENTIALITY AND PRIVACY
Public Estate Planners™ must take reasonable steps to protect the confidentiality and privacy of client information.
Client information should only be collected, used, disclosed, and retained in accordance with applicable laws and privacy obligations.
COMPLIANCE WITH APPLICABLE LAWS
Public Estate Planners™ must comply with all applicable laws, regulations, and professional obligations relevant to their activities.
Certification does not exempt any individual from complying with applicable legal or regulatory requirements.
USE OF THE PUBLIC WILLS PLATFORM
Public Estate Planners™ must use the Public Wills platform responsibly and in accordance with the Public Wills Terms of Use.
Users must not misuse the platform, attempt to circumvent platform controls, share account credentials, or engage in activities that may compromise the security, integrity, or reputation of the platform.
CERTIFICATION STATUS
Public Estate Planners™ may only represent themselves as certified while their certification remains active and in good standing.
Upon suspension, revocation, expiration, or termination of certification, individuals must immediately cease representing themselves as a Public Estate Planner™.
BREACHES AND DISCIPLINARY ACTION
Public Wills reserves the right, at its sole discretion, to investigate potential breaches of this Code of Conduct.
Where a breach is identified, Public Wills may take appropriate action, including:
- Issuing warnings;
- Requiring remedial action or additional training;
- Suspending certification;
- Revoking certification;
- Suspending or terminating access to the Public Wills platform.
Public Wills reserves the right to take such action where conduct may harm clients, the Public Wills platform, the Public Estate Planner™ certification programme, or the reputation of Public Wills.
